A Federal High Court sitting in Abuja has struck out a suit seeking to disqualify Osun State Governor, Adegboyega Oyetola, from participating in Saturday’s governorship election.
The suit was filed by the faction of the All Progressives Congress (APC) loyal to former governor of the state and Minister on Interior, Rauf Aregbesola.
Oyetola and Aregbesola have been at loggerheads over the control of the party and issues of governance in the state.
Former Secretary to Osun State Government, Moshood Adeoti, who is backed by the Aregbesola faction, went to court after Oyetola was declared winner of the party’s governorship primary election.
Adeoti asked the court to determine if Oyetola was eligible to contest the election owing to the fact that he was a member of the APC national caretaker committee at the time.
Delivering judgement on Thursday, Justice Inyang Ekwo, held that Adeoti failed to support his suit “with the relevant laws.”
The judge held that the suit was not in line with section 87(9) of the electoral act and section 22 of the country’s constitution.
