The Supreme Court has affirmed the election of Dauda Lawal as the duly elected governor of Zamfara State.
Justice Emmanuel Agim, who read the lead judgement, described the Appeal Court judgement which ordered rerun in some polling units as perverse.
“The allegations of non-accreditation, no conduct of elections or overvoting must be proved with BVAS, voters register, form EC8A, form EC40G as well as the testimony of the polling unit officers or party agents.
“The tribunal was right to have affirmed the election of Dauda Lawal Dare of the PDP as the allegations made by the petitioners were not proven,” he said.
Justice Agim said the decision of the Court of Appeal has no evidential foundation.
“The court of appeal ought not to have overturned the judgement of the tribunal.
“The order that fresh elections be conducted in Zamfara is set aside,” the court held.
